Regulatory Reform (Fire Safety) Order 2005

The Regulatory Reform (Fire Safety) Order 2005 outlines responsibility within organisations with regard to fire safety. Employee responsibility and training is a key aspect of the legislation, with sections dedicated to fire safety duties, enforcement and offences for the workplace.

General

Part one of the Regulatory Reform (Fire Safety) Order 2005 outlines general information regarding the regulations themselves and the definitions of employee and management roles within the fire safety strategy for an organisation. This section covers various aspects of workplace characteristics and general fire precautions, including measures to reduce the risk of fire as well as the means to handle it if it does arise.

Fire Safety Duties

Part two of the Regulatory Reform (Fire Safety) Order 2005 outlines numerous aspects of responsibility in terms of the activities workplace staff engage in for fire prevention and management. This includes a detailed overview of risk assessment duties with regard to fire safety. Also covered in this section is responsibility with regard to dangerous substances, including the duty to eliminate or reduce the risks posed by the use of such materials.

Part two also covers fire fighting and detection, including an outline of the equipment required for both tasks and an indication of the measures the designated “responsible person” must implement. Emergency exits and routes also fall under this section, with specifications listed detailing requirements for doors, signage and lighting in situations involving evacuation.

This part of the regulations also indicates employer duties for maintenance of equipment such as fire extinguishers, employee training and management to facilitate co-ordinated fire safety management within a workforce.

Enforcement
Part three of the Regulatory Reform (Fire Safety) Order 2005 covers enforcement, including authorities, inspection, orders and notices. Roles for bodies such as the Health and Safety Executive are outlined here, as are the powers held by inspecting officers with regard to fire safety. Following an inspection, a workplace may be issued a notice outlining any issues that need to be addressed. Part four of the Regulatory Reform (Fire Safety) Order 2005 covers offences, defence and appeals with regard to fire safety legislation and the workplace. Convictions and fines resulting from fire safety offences are indicated in this section, as are court proceedings for appeals.

Part five of the Regulatory Reform (Fire Safety) Order 2005 outlines a number of additional aspects of fire safety including matters relating to fire fighters, civil liabilities, employee consultation, licensing, byelaws and repeals.
